1. Acceptance of Terms
By installing, accessing, or using PC Builder MW ("App"), you ("Merchant") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference.
If you do not agree with any part of these Terms, you must not install or use the App. These Terms constitute a legally binding agreement between you and Miracle Websoft ("we", "us", "our").

PC Builder MW is a Shopify application designed exclusively for use with Shopify stores. To use the App, you must:

Your relationship with Shopify is governed entirely by Shopify's own terms. We are not responsible for Shopify's services, availability, or any actions taken by Shopify.
3. Subscription Plans and Billing
3.1 Plans
PC Builder MW is offered on the following monthly subscription plans:
Plan details, pricing, and features are subject to change. We will provide at least 30 days' notice before changing pricing for existing subscribers.
3.2 Billing
All subscription fees are billed monthly through Shopify's billing system. Charges appear on your Shopify invoice. By approving the App's billing through Shopify, you authorise Shopify to charge the applicable subscription fee to your Shopify payment method on a recurring monthly basis.
We do not directly handle, store, or process payment card information. All payment processing is conducted by Shopify in accordance with their payment terms and PCI DSS standards.
3.3 Free Trial
New installations receive a 14-day free trial. During the trial:
After the trial period, you must subscribe to a paid plan to continue processing orders. Your widget and configuration are preserved if you subscribe within 30 days of trial expiry.
3.4 Cancellation
You may cancel your subscription at any time through your Shopify admin under Apps → PC Builder MW → Plan. Cancellation takes effect at the end of your current billing period. No refunds are provided for unused portions of a billing period.
Upon cancellation, your widgets will stop processing new orders. Your configuration data will be retained for 30 days, after which it will be permanently deleted.
3.5 Refunds
All subscription fees are non-refundable except where required by applicable law. If you believe a charge was made in error, contact us at reach.miraclewebsoft@gmail.com within 14 days of the charge and we will investigate.

Subject to your compliance with these Terms and timely payment of applicable fees, Miracle Websoft grants you a limited, non-exclusive, non-transferable, revocable licence to:

6. Your Data and Content
You retain ownership of all data, content, and intellectual property that you upload, import, or create within the App ("Your Content"), including product data, compatibility rules, widget configurations, and customer data.
By using the App, you grant Miracle Websoft a limited, non-exclusive licence to access, process, and use Your Content solely for the purpose of providing the App's services to you.

As the merchant, you are the data controller for your customers' personal data. Miracle Websoft acts as a data processor on your behalf. Our data processing practices are described in our Privacy Policy.
7. AI Features
The App offers AI-powered features ("AI Fill") that use large language models to generate product content:
Basic Plan — Bring Your Own API Key:
When you provide your own Google Gemini or OpenAI API key, your product data is sent directly to that provider's API. Your use of those services is subject to their respective terms of service and you are responsible for any costs associated with your API usage.
Pro Plan — Built-in AI:
The Pro plan includes built-in AI access. Product data submitted for AI fill is processed by our integrated AI service and is not used to train AI models or shared with third parties beyond what is necessary to provide the service.
Accuracy Disclaimer:
AI-generated content may contain errors, inaccuracies, or inappropriate content. You are responsible for reviewing all AI-generated content before publishing it in your store. Miracle Websoft makes no warranty regarding the accuracy or suitability of AI-generated content.
8. Intellectual Property
The App, including all software, design, text, graphics, logos, and documentation, is the exclusive property of Miracle Websoft and is protected by copyright, trademark, and other intellectual property laws.
Our trademarks: "PC Builder MW", the PC Builder MW logo, and "Miracle Websoft" are trademarks of Miracle Websoft. You may not use these marks without our prior written consent.
Feedback: If you submit suggestions, feature requests, or other feedback about the App, you grant Miracle Websoft a royalty-free, perpetual licence to use that feedback without any obligation to compensate you.
9. Third-Party Services
The App integrates with or depends on third-party services, including:
Your use of these third-party services is subject to their respective terms and policies. Miracle Websoft is not responsible for the availability, accuracy, or practices of any third-party service. We are not liable for any losses resulting from your use of or reliance on third-party services.
10. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Miracle Websoft DOES NOT WARRANT THAT:
Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MIRACLE WEBSOFT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Termination by you: You may terminate these Terms at any time by uninstalling the App from your Shopify store and cancelling your subscription.
Termination by us: Miracle Websoft may suspend or terminate your access to the App immediately, without prior notice, if you:
Effect of termination: Upon termination, your licence to use the App ends immediately. Provisions that by their nature should survive termination (including ownership, disclaimer, limitations of liability, and indemnification) shall survive.
14. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of Punjab, India, without regard to conflict of law principles.
Dispute Resolution: We encourage you to contact us first at reach.miraclewebsoft@gmail.com to resolve any dispute informally. If informal resolution is not possible, disputes shall be resolved through binding arbitration in Punjab, India, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis only. Class action lawsuits, class-wide arbitrations, or any other representative proceedings are not permitted.

We may modify these Terms at any time. We will notify you of material changes by:

16. General Provisions
Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Miracle Websoft regarding the App and supersede all prior agreements.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights and obligations to a successor in connection with a merger, acquisition, or sale of assets.
Force Majeure: We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including natural disasters, acts of government, internet outages, or third-party service failures.
